The Federal High Court sitting in Osogbo, State of Osun, on Thursday rejected an objection by the Osun State Independent Electoral Commission, OSSIEC, and the All Progressives Congress APC, to strike out the suit filed against the conduct of the October 15 local government election in the state.
The court also struck out, an objection to discontinue the case, on the grounds that it lacked jurisdiction to hear the matter.
Counsel to OSSIEC, Abiodun Saka-Layoonu SAN, filed the objection.
Counsel to the PDP, Barrister Hashim Abioye said the plaintiff had sought an amendment to the suit, before the defendant’s plea, which the court failed to grant.
He told OSUN DEFENDER: “The court did not stop the Local Government election. It only overruled the injunction they sought against our case.
“The PDP filed an application for amendment, but the APC objected to the case and asked the court to strike it out, that the it lacked the jurisdiction to hear the case.
“The court, therefore overruled their objection, to strike the case out and did not rule on the application to stop the conduct of the election.
“The implication of this is that they must not do anything as preparation for the election yet.”
