Rivers NBA Accuses Sole Administrator Of Undermining Democracy
The Nigerian Bar Association (NBA) has expressed strong disapproval of the actions taken by the Sole Administrator of Rivers State, accusing him of undermining democratic institutions and disregarding the rule of law.
In a statement issued by the chairpersons of eight NBA branches across Rivers State, the association raised concerns over the arbitrary dissolution of various state bodies, including boards, commissions, councils, and other government entities.
They condemned the appointment of replacements without adhering to constitutional guidelines.
The NBA specifically took issue with the appointment of administrators to oversee the 23 Local Government Area Councils in the state.
The association referenced a recent Supreme Court ruling that prohibits the appointment of caretaker committees to manage local governments, reinforcing their opposition to such actions.
The NBA called on the Sole Administrator to refrain from these undemocratic practices and focus on his designated role, which involves safeguarding federal assets and ensuring stability within the state.
Additionally, the association urged the Sole Administrator to avoid becoming entangled in political matters that could further heighten tensions in Rivers State.
They emphasized that he should remain neutral and not act as a representative of any political party.
The statement reads, “It is our firm view that the Sole Administrator’s mandate does not encompass the actions he has taken, including dismantling democratic institutions such as boards, agencies, councils, commissions, and parastatals, nor appointing replacements for officials who were removed from office. These actions contravene established procedures for the removal and appointment of such officers in the state.”
The NBA further stated, “The responsibilities of the Sole Administrator do not extend to preparing or presenting budgets, particularly for infrastructural development in the state. Moreover, it does not authorize the appointment of administrators to manage the 23 Local Government Areas, a clear violation of both the Constitution and court rulings that stipulate such councils should be governed by elected chairpersons, not appointed administrators.”
The NBA also condemned the actions of the Nigerian Police, accusing them of harassing, intimidating, and assaulting peaceful protesters and journalists.
The association regarded these acts as violations of constitutional rights to peaceful assembly and free expression.
Offering its legal support, the NBA pledged to assist victims of police misconduct through its Human Rights Committees.
They called on the Nigerian Police and other security agencies to focus on maintaining order rather than exacerbating existing tensions.
The association appealed to President Bola Ahmed Tinubu and the National Assembly to intervene and ensure that the Sole Administrator stays within his designated mandate.
They also urged the National Assembly’s Peace or Reconciliation Committee to step in and help foster dialogue and reconciliation in Rivers State.
The NBA reaffirmed its commitment to upholding the rule of law and providing pro bono services for individuals whose rights have been violated.
