LG Crisis: Osun Court Grants Leave To Quash Criminal Case Against UBA

The Osun State High Court sitting in Osogbo on Friday issued Leave to the United Bank for Africa UBA for quashing the criminal proceedings instituted by the state government and being held at the Magistrate Court in Osogbo.

The Leave was granted by Justice M. O. Agboola, in the Suit Hos/M4/2026.

Reacting to the development, the leader of the local government chairmen elected under the All Progressives Congress, Hon. Abiodun Idowu, lauded the High Court decision saying the Leave granted to the UBA officials is an affirmation of the supremacy of the rule of law.

Idowu, however, frowned at the bench warrant issued against some senior officials of the United Bank of Africa by a Magistrate’s Court in Osogbo on Friday.

OSUN DEFENDER reports that the Magistrate Court issued an arrest warrant against the United Bank for Africa Plc (UBA) and three of its senior officials over the alleged illegal operation and maintenance of bank accounts in the name of the 30 local government councils in the state.

In a certified true copy of the order titled “Warrant for Arrest of Defendant Who Has Disobeyed Summons (General Title – Form No. 1)”, addressed to the Osun State Commissioner of Police, the court stated in part: “Complaint has been made that the defendant(s) did allow unauthorised persons to operate and maintain 30 accounts opened in favour of the 30 Local Government Councils in Osun State with UBA Bank Plc.

But Abiodun described the issuance of a bench warrant as bizarre, adding that it beats the imagination of any right-thinking member of the public.

“Meanwhile, the Magistrate A. A. Adeyeba who is a party in the Suit still issued a bench warrant against some officials of the UBA notwithstanding of being aware of a Leave earlier granted on the same day by the High Court to the UBA seeking to quash the proceedings in the matter before the Magistrate.

“Magistrate Adeyeba who is also a party in the High Court matter is expected to await the decision of the Superior Court over the determination of the validity of charge No. Mos/601c/2025 once the Leave had been granted but refused to honour the ruling and went ahead to issue a bench warrant.

“In the same vein, the Magistrate ignored the pendency of Suit No. FHC/OS/CS/19/2026 in which the Magistrate is also a Defendant instituted by the reinstated Chairmen and Councillors to challenge illegality being perpetrated at the Magistrate Court over the purported charge,” he said.

Abiodun advised members of the public to remain calm and be law-abiding while the Illegality is being lawfully fought in the court of law.
