2026: Omisore Asks Court To Stop INEC From Recognising Oyebamiji As APC Candidate

The former deputy governor of Osun State and immediate past National Secretary of the All Progressives Congress, Senator Iyiola Omisore, has dragged the party and the Independent National Electoral Commission before an Osogbo Federal High Court over the gubernatorial primary election of the APC in Osun State.

According to court documents obtained by OSUN DEFENDER on Wednesday, Omisore who was one of the disqualified aspirants under the APC in suit no FHC/OS/CS/261/2025, asked the court to determine whether the APC which is the 1st defendant has the power to impose nomination qualification, or disqualification criteria, measures, or conditions on any aspirant for its primary election in its
constitution, guidelines, or rules for nomination of candidates.

The former deputy governor in the original summons dated December 09, 2025, also urged the court to determine whether the decision of the APC to set guidelines and rules for aspirants/candidates for its Osun State Governorship primary election and the
subsequent disqualification of the Plaintiff as a governorship aspirant is not in contravention of Section 84 (2) & (3) of the Electoral Act 2022 (as amended) as well as Sections 177 and 182 of the 1999 Constitution of the Federal
Republic of Nigeria (as amended).

Omisore also asked the court to determine whether the APC can validly disqualify him as a governorship aspirant for the Osun State Governorship primary election, having met the constitutional requirements of Section 177 and 182 of the Constitution of the Federal Republic of Nigeria.

He asked the court to declare that the APC has no power to impose nomination qualification, or disqualification criteria, measures, or conditions on any aspirant for its primary election in its constitution, guidelines, or rules for nomination.

He also sought a declaration that the 1st Defendant cannot validly disqualify him as a governorship aspirant for the Osun State Governorship primary election.

Omisore asked the court for an “Order voiding and/or setting aside the purported disqualification of the plaintiff as an aspirant at the 1st defendant governorship primary election for the election of a governorship candidate to represent the 1st Defendant at the
Osun State’s forthcoming Governorship Election, having failed to comply with the requirement for the nomination of a candidate for election.”

The former APC national scribe also sought an order of the court mandating the APC to present him as an aspirant for its primary election for the nomination of candidate for the Osun State Governorship election.

He asked the court to order an injunction and restrain the Independent National Electoral Commission which is the 2nd Defendant from recognising any primary election for the nomination and election of a governorship candidate by the APC for the Osun State Governorship Election.

OSUN DEFENDER reports that the APC on December 13, 2025, held its primary election where Mr Bola Oyebamiji was nominated as the consensus candidate of the party.

Oyebamiji was nominated as the consensus candidate after Omisore and six other aspirants were disqualified by the All Progressives Congress Screening Committee from contesting the governorship primary.

The committee cited gaps and irregularities in their nomination processes.

Following their disqualification, Omisore accused the Minister of Marine and Blue Economy, Gboyega Oyetola, of masterminding the disqualification of him and the six other gubernatorial aspirants for the Osun State election.

In a video obtained by OSUN DEFENDER, Omisore, who was flanked by Alabi, Ogunbiyi, Adegoke, Omoworare and Oralusi, alleged that the panel chairman confirmed that he was pressured by Oyetola to disqualify them.

He described the screening committee report as a joke taken too far.

He said, “The panel report is the most ridiculous report of this year. It is quite unfortunate that people are taking partisanship beyond politics.

“As we speak today, none of us has seen the report to know why we were disqualified. When you disqualified people like us from any contest, where do you go from there?

“The chairman of the first panel called us to say that Mr Gboyega Oyetola called him to say that he must disqualify us because his poster boy, Bola Oyebamiji, must win.

“We’ve met the appeal panel, and I asked them what the basis for our disqualification was. They should have used another tactic.”
