Adeleke’s Aide Files N50m Fundamental Rights Suit Against APC Spokesperson, Others
The chairman of Osun State Universal Basic Education Board (SUBEB), Mr Ibukun Fadipe, has filed a fundamental rights suit against the All Progressives Congress and its spokesperson in Osun State, Mogaji Kola Olabisi.
Joined as 1st to 9th respondents in the suit no HIC/m28/26 dated March 25, and filed at a state High Court, Ilesa, were the Inspector General of Police, the Osun State Commissioner of Police, Director General, Directorate of State Security Services, Director of Directorate of State Security Services, Osun command.
Others are; the Commandant General, Nigeria Security and Civil Defence Corps, Osun State Commandant of NSCDC, Commandant General of Nigeria Immigration Services, the Osun State Commandant of Immigration, the Attorney General and Commissioner for Justice, Osun State.
In the originating summons, Fadipe prayed the court to declare that continued harassment, intimidation, persecution
and/or any attempt by the respondents to re-open, re-investigate, re-arrest, or prosecute him in connection with the death of one Chief Raheem Ade Komolafe, is unlawful, unconstitutional, null and void a violation of his right to personal liberty.
The SUBEB boss said he had been formally exonerated by the Ministry of Justice via its legal advice on the matter.
He also sought a declaration that any attempt to reopen the criminal investigation, procure a fresh arrest of, or institute fresh criminal proceedings against him touching upon the death of Chief Ade Komolafe matter conclusively disposed of by the Ministry of Justice in June 2010 constitutes a gross violation of his right to a fair hearing.

Fadipe also sought “a declaration that the campaign of calumny, public accusations, and political persecution orchestrated by the spokesperson for Osun APC and the party or its operatives against him in connection with the settled matter of Chief Ade Komolafe’s death, constitute an
infringement of his right to the dignity of the human person.”
Also, he asked the court to declare that the use of political machinery and state security apparatus to selectively re-activate a criminal allegation that was formally laid to rest by the Ministry of Justice amounts to an abuse of process and violation of the rule of law.
Fadipe therefore prayed for an order of perpetual injunction restraining the respondents, whether by themselves, their agents, servants, privies, or any person
acting on their instruction or behalf, from re-investigating,re-arresting or prosecuting him in connection with the death of Chief Raheem Ade Komolafe or any matter
arising there from.
“An order compelling the 1st and 8 Respondents to refrain from acting
on any petition or directive, whether from the APC, its officials, or any person whatsoever, that is directed at reopening the settled matter of Chief Ade Raheem Komolafe’s death is against him.”
He also asked the court to order the payment of N50 million to him as general
and exemplary damages for the deliberate, wilful, and politically motivated violation of his fundamental rights against the defendants jointly and severely.
