Airport Saga: Kwam 1 Faces Life Imprisonment, N25m Fine If Prosecuted, Found Guilty
Nigerians are keenly watching the federal government on the steps it will take concerning the issue of veteran Fuji musician, Wasiu Ayinde, popularly known as K1 De Ultimate.
OSUN DEFENDER reports that the musician caused a scene on Tuesday, August 05, at the Nnamdi Azikiwe International Airport when he obstructed a ValueJet aircraft from proceeding to the runway.
In a video obtained by OSUN DEFENDER, Ayinde was seen standing in front of the airplane in an attempt to stop it from taking off.
Following the incident, the Minister of Aviation and Aerospace Development, Festus Keyamo, directed that the Fuji musician be placed on a no-fly list, describing his actions at the Airport as “akin to a hostage situation.”
Also, the Nigeria Civil Aviation Authority (NCAA) has petitioned the Attorney-General of the Federation (AGF), Lateef Fagbemi; and the Inspector-General of Police (IGP), Kayode Egbetokun; to prosecute the musician over the incident.
However, some people believe the musician’s relationship with President Bola Tinubu may shield him from being prosecuted.
Ayinde is the official musician of the All Progressives Congress and has at different fora aligned with President Tinubu.
Meanwhile, the Fuji musician is liable to life imprisonment if prosecuted and found liable for the allegation leveled against him by the Aviation Minister.
According to Section 83 of the Civil Aviation Act 2022, “Anybody who attempts, seizes or exercises control of an aircraft using intimidation or threat has committed an offence called ‘Hijacking’ and the punishment is, if guilty, liable to at least N25 million fine and life imprisonment.”
Also, while the musician has denied that the flask he was carrying that day contained alcohol, as insinuated by the NCAA, the law on anyone carrying a liquid substance on an aircraft is very clear.
On the carriage of liquids, aerosols, and gels on an aircraft, the law states that it must “be in a container not bigger than 100 ml which must then be put in a transparent plastic bag that must be submitted for screening and approval of cabin crew.”
Meanwhile, the pilots, Captain Oluranti Ogoyi and the co-pilot, First Officer Ivan Oloba, who flew the ValueJet aircraft, are also liable to a fine or prison term or both if found guilty of causing or taking an action that can cause danger to any person or property.
According to Section 81 Civil Aviation Act 2022 “where an aircraft is operated in such a way that can cause danger to any person or property, whoever is the pilot of that aircraft and any responsible for the safety of that aircraft commits an offence and his liable to a fine of at least N2million or two years imprisonment or both.”
