On Monday, the Court of Appeal sitting in Ibadan, Oyo State has reinstated Biyi Otegbeye as the governorship candidate of the African Democratic Congress (ADC) in Ogun State.
The court set aside the judgement of the Federal High Court in Abeokuta, which ordered the Independent National Electoral Commission (INEC) to annul 23 Ogun ADC Assembly candidates from its list.
The All Progressives Congress (APC) filed a lawsuit before the trial court challenging the ADC’s primaries. The court, in a unanimous decision delivered by Justice M. A. Adumein, held that the lower court lacks jurisdiction to decide the case.
The court then overturned the judgment and every order issued by the trial court due to lack of jurisdiction.
However, the appellants were given a N50,000 cost award by the court.
