A magistrate court sitting in Osogbo has issued a bench warrant against Adebayo Aminu who is standing surety before the court for refusing to show up in court.
Adebayo, a surety for an accused person, Owolabi Simeon who was arraigned over an alleged stealing and fraud did not appear in court when his case was mentioned.
The prosecutor, Mr. Lamidi prayed the court to issue a bench warrant against the surety because he called him personally to show up in court but he said he would not because he was afraid to come to court.
He added that this is not the first time both the surety and the accused person have ceased to show up in court and all their efforts to get in touch with the accused person was in vain.
Lamidi said ever since the accused person have been issued a bench warrant due to his absence in court, on March 13, 2018, he is yet to show up.
The defence counsel, Mr. Chibueze Collins prayed the court not to grant the prosecutor wishes but he was overruled.
Presiding Magistrate, Mr. O. T Badmus said he told the surety on the day the accused person was bailed whether he understood the implication of standing for an accused person? and he respond positively.
He later issued a bench warrant on the surety and adjourned the case till November 2, 2018.
