Court Rules On ASUU Appeal Today As Out-Of-Court Settlement Fails

The Court of Appeal will deliver a ruling on an application by the Academic Staff Union of Universities, seeking permission to appeal against the order of the National Industrial Court today.

Following the Appeal of ASUU that the NIC judgement which ordered them to resume be set aside, Justice Barka Hamma, of the Court of Appeals after taking arguments from the two parties, announced that the ruling of the court would be delivered on October 7 but advised the two parties to settle out of court by Thursday Oct. 6 ( yesterday ).

Lawyers for the Federal Government and ASUU on Thursday ( yesterday ) however told the Court of Appeal that both parties could not settle for an out-of-court settlement as advised by the court. Falana suggested that their application challenging the ruling of the Industrial Court, be heard by the three-man panel of the Appeal court.

Both parties agreed that the court should hear the application, as there was no amicable resolution reached as advised by the court.
