Court Strikes Out N750,000 Suit Against Contractor In Osun

 

A magistrate’s court sitting in Osogbo, the capital of the State of Osun, has struck out a case against a contractor with the Osun Rural, Water and Environmental Sanitation Agency (RUWESA), Adekanmi Adenipekun.

Adenipekun had been alleged to have obtained a sum of N750, 000 from RUWESA, an amount meant for the payment of contract executed for the agency by Felix Afolabi and Bashiru Olaitan.

According to the charge sheet, Adenipekun refused to pay both Afolabi and Olaitan after collecting the money.

He however pleaded not guilty to the two-count charges preferred against him.

The magistrate, Segun Ayilara, had earlier ordered an out-of-court settlement on the matter, following a plea by Adenipekun’s lawyer, Michael Abioye.

The case, with suit number MOS/9691C/2018, was however struck out last Friday after Adenipekun completed the payment of the N750, 000.

Speaking after the case, Abioye said Adenipekun was charged to court by the duo of Afolabi and Olaitan against RUWESA authority’s consent.

He said: “It was not RUWESA that filed the suit.  The duo of Afolabi and Olaitan did. My client awarded subcontract of N10.2million to them and he had paid N9.45million before they took him to court.

“The balance was to be paid from the five per cent retention payment that he was expecting from RUWESA.  Their N750, 000 is less than one percent of their contract sum of N10.2m and less than five percent my client was expecting from RUWESA.

“What that means is that my client had not received the outstanding contract sum from RUWESA as at the time he was dragged to court for defaulting. The complainants were not just patient. But it is over now.”
