EDITORIAL: Need For A Constitutional Court?

 

YESTERDAY’S dismissal of the suit by Alh. Moshood Adeoti, a leading member of the APC seeking to disqualify fellow party member, Governor Oyetola from tomorrow’s governorship contest does not end the matter. On the contrary, it might become the beginning of a 90-day saga through the appellate courts which terminates at the Supreme Court.  Adeoti, a chieftain of the APC, is an aspirant of the February 19, 2022 APC governorship primary fin the state. But he lost the ticket to Governor Oyetola.

There is a lot at stake. We also have different interpretations of the landmark decision in the Rotimi Amechi case.  It brings up to the fore, once again, the issue of whether or not Nigeria should have a Constitutional Court with originating and terminating status as is the case in so many countries, so as to speedily resolve knotty constitutional issues.

Constitutional courts in places such as South Africa have admirably acted as a fulcrum for the consolidation, extension and deepening of the democratic process.
