Emirship Tussle: Kano Govt Speaks On Appeal Court Judgement

The Kano State Government has cleared the air over the recent judgement delivered by the Court of Appeal concerning the ongoing emirship tussle in the state.

On Friday, the appellate court ruled on an appeal challenging an earlier decision of the Federal High Court, which had nullified the Kano State Government’s repeal of the 2019 Emirate Council Law.

The court temporarily halted the enforcement of its judgement, pending the determination of an appeal filed before the Supreme Court.

Addressing journalists shortly after the ruling, the Attorney-General and Commissioner for Justice in Kano, Haruna Dederi, stated that the judgement does not invalidate the reinstatement of Alhaji Muhammadu Sanusi II as the 16th Emir of Kano.

He explained that while the court has ordered the maintenance of the status quo, its ruling does not nullify the earlier judgement delivered on January 10, which upheld the decision of the Kano State Government.

“The appeal court today, after hearing their application for a stay of execution, ruled that the status quo should rather be maintained as it is now until after the judgement of the Supreme Court. They have filed an appeal at the Supreme Court,” Dederi stated.

“It doesn’t mean that the judgement delivered on January 10, 2025, has been quashed. That judgement is still standing, still in place, and subsisting. The Court of Appeal cannot reverse its own decision. It is not possible. Only the Supreme Court has the power to set aside the judgement given by a lower court.”

The commissioner further clarified that the stay of execution granted by the Court of Appeal simply means that the implementation of the judgement remains on hold until the Supreme Court delivers its verdict on the appeal filed by Aminu Baba Dan Agundi on behalf of Emir Aminu Ado Bayero.

Background To The Crisis

The Kano Emirate crisis dates back to May 2024, when Governor Abba Kabir Yusuf signed a new law repealing the 2019 Emirate Council Law, which had split the Kano Emirate into five jurisdictions.

The repeal paved the way for the reinstatement of Sanusi, who had been dethroned in 2020 under the previous administration.

Dissatisfied with this development, Aminu Agundi and Sarkin Babba of the Kano Emirate filed a suit at the Federal High Court, seeking to restrain the government from implementing the law.

On June 20, the court ruled in their favour and nullified the government’s actions. However, the Kano State Government appealed the ruling, leading to the latest decision by the appellate court.
