Ex-Dunamis Pastor, Enenche File Petition Against Magistrate Over Alleged Judicial Misconduct

Former Dunamis pastor Abraham Daniel and Obonyilo Enenche Peter, have filed a petition against Chief Magistrate Emmanuel A. Iyanna of the Wuse Zone 6 Magistrate Court, Abuja, accusing him of bias and judicial misconduct.

In the petition dated June 16, 2025, and addressed to the Chief Judge of the Federal Capital Territory (FCT), the duo alleged that Magistrate Iyanna was acting in the interest of Pastor Paul Enenche, Senior Pastor of Dunamis Church, who is the complainant in their ongoing criminal case.

They claimed that after they submitted their initial complaint on March 17, 2025, Magistrate Iyanna became “extremely angry and furious,” openly blaming the case for causing him personal difficulties.

The petitioners further alleged that the magistrate manipulated the court calendar to favour the complainant, rescheduling their matter without notice and refusing to hear their motion challenging the remand order against them.

“Due to desperation to achieve certain pre-conceived plans, the matter was unilaterally and surreptitiously brought back from the earlier agreed date being 26th May, 2025 to Friday 25th April, 2025,” the petition read.

They accused the magistrate of revoking bail granted to the first defendant based on personal knowledge, thereby violating the principle of impartiality in judicial proceedings.

“Magistrate Iyanna in revoking the bail of the 1st defendant injected his personal knowledge of the facts which further triggered his bias,” the petition stated.

They cited the legal principle of *nemo judex in causa sua* (no one should be a judge in his own cause) and maintained that Iyanna’s closeness to Pastor Enenche made him unfit to continue presiding over the case.

The petitioners also referenced the magistrate’s controversial record, including his involvement in issuing a search warrant on the home of retired Supreme Court Justice Mary Odili and another on PDP governorship candidate Umo Eno.

They warned that if disciplinary actions are not taken, Magistrate Iyanna “may bleed the judiciary to death,” and added that they had lost all confidence in his ability to deliver justice in their matter.

A copy of the petition was also forwarded to the Chief Justice of Nigeria.
