Lagos: Makoko Demolitions Entirely Illegal, Says Falana
Human rights lawyer, Femi Falana, has stated that any attempt to demolish or displace people from waterfronts is entirely illegal.
Falana made the remarks on Sunday during an interview on Arise Television, emphasising that citizens are entitled to the right to housing and dignity.
He added that governments planning demolitions must first engage affected residents and provide alternative accommodation.
The senior lawyer said there was no justification for tear-gassing peaceful protesters.
“Incidentally, I’ve been involved in issues concerning house demolitions in Lagos for the past 35 years. To top it up, the Supreme Court ruled two years ago that state governments have no control over inland waterways. Therefore, going to any waterfront to demolish or displace people is completely illegal,” he said.
Falana clarified that he is not against development but insisted that government actions must be humane.
“Section 17 of the Constitution provides that all actions of the government shall be humane. You cannot enter a community in the dead of night, tear-gas residents, confuse them, and then begin demolishing their properties. That is not the law. Citizens have a right to dignity and housing. If the government intends to demolish, it must first discuss with residents and provide alternative housing,” he added.
