An Osogbo Magistrate Court in Osun State has sentenced a 30 year-old man, Oladejo Wasiu to six months imprisonment for house breaking and stealing.
Wasiu was arraigned on April, 2 2018 together with Faleye Azeez, 26 and Salihu Jelili 35 on a four-count charge.
The convict pleaded not guilty on the first day of arraignment and was admitted into bail but latter remanded in Ilesha prison custody when he could not perfect his bail conditions while the duo that was docked together with him perfected their bail conditions.
When the case was called for hearing, the Prosecutor, Inspector Olayiwola Rasaq told the court that the convict and others at large conspired to commit felony to wit house breaking and stealing on March 14, 2018 at Alabameta area in Osogbo.
He explained that the convict and others at large entered into the dwelling house of one Alhaja Alimot Olore and carted away her property and some cash.
According to the prosecutor, some of the property stolen by Wasiu are listed as follows. 21 bundles of Ankara clothe, 5 bundles of Guinea brocad clothes, 16 bundles of lace materials, 7 pieces of baby wear, 3 pieces of baby sawl, pack of baby handkerchief, one LG DVD, Jewelries among others.
The prosecutor tendered all the property and the statement of the accused as exhibit before the court.
The motorcycle of the convict was also tendered as exhibit.
The convict, an indigene of Ikirun having no legal representation admitted to the crime and begged for pardon.
He also told the court that the two accused (Azeez and Jelili) that were docked together with him had no hands in the crime, adding that Azeez was his herbalist who did some protection charms for him free of charge, adding that they were friends and did not know the defendant was a thieve.
Magistrate O A Oloyade thereby discharged and acquitted Faleye Azeez and Salihu Jelili that were arraigned with the accused person, saying the duo were innocent and warned them to desist from bad company.
She then convicted Wasiu on the four count charges and sentenced him to Six months imprisonment with option of N5,000 fine on the ground that the convict had been in prison custody since the day of his arraignment.
She also ordered that the property recovered from the convict be returned back to the owner and that the motorcycle belonging to him be returned back to him after serving his jail terms.
