NBA Condemns Judge Who Allegedly Ordered Sowore’s Lawyer to Kneel in Court

The Nigerian Bar Association (NBA) has condemned an incident at the Federal High Court, Abuja, on Monday, where a judge allegedly ordered a lawyer to kneel during proceedings, calling the act unlawful and inconsistent with judicial standards.

NBA President, Afam Osigwe (SAN), in a statement on Tuesday, said the association was concerned about reports that Justice Mohammed Umar directed lawyer Marshall Abubakar to kneel while representing activist and former presidential candidate, Omoyele Sowore.

The incident reportedly followed a disagreement over a hearing date, during which Abubakar allegedly raised his voice in court.

Osigwe described the development as “most serious,” stressing its implications for the dignity of the legal profession and the integrity of the judiciary.

He said, “The courtroom is a temple of justice, governed by law, procedure, and decorum. While judges have authority to maintain order, it must be exercised strictly within legal bounds and judicial standards.”

He added that although courts can punish for contempt, such powers are limited by due process and cannot be applied arbitrarily.

“Ordering a lawyer or any person to kneel in court is not a recognised judicial sanction under our laws and does not align with the standards expected on the Bench,” Osigwe said.

The NBA president emphasised that the dignity of the court must be reflected not only in rulings but also in how judicial authority is exercised.

“If a judge believes a person has acted contemptuously, proceedings must follow established legal procedures,” he said.

At the same time, the association reminded lawyers of their duty to act professionally and respectfully in court.

“While lawyers must advocate firmly for their clients, this must always be done within the bounds of courtesy and decorum,” Osigwe said.

He highlighted the importance of a balanced relationship between the Bar and the Bench for the proper administration of justice.

“The legal profession thrives on mutual respect between the Bar and the Bench,” he said.

The NBA called for calm among all parties and urged that disputes arising from courtroom incidents be resolved through institutional and disciplinary channels.

Osigwe assured that the association would engage relevant authorities to uphold the rule of law and judicial ethics.
