Supreme Court To Deliver Judgement On Withheld Osun LG Funds Friday

The Supreme Court is set to rule on Friday, December 5, in a case seeking to restrain the Attorney General of the Federation (AGF) from releasing withheld local government funds to disputed Osun APC Chairmen and Councillors.

Justice Uwani Aba’aji, leading a seven-member panel, reserved judgment in October after hearing arguments from counsel representing the Osun State Attorney General, Musbau Adetunbi, SAN, and Chief Akin Olujimi, SAN, representing the AGF.

The suit, SC/CV/773/2025, was filed by the Osun State Attorney General, requesting that the AGF be barred from paying statutory allocations to the sacked APC officials.

Adetunbi argued that recognizing the APC Chairmen and Councillors while the matter was in court was unlawful, noting that their election had been nullified by the Federal High Court and upheld by the Court of Appeal in Abuja.

Opposing the suit, Chief Akin Olujimi, SAN, asked the Supreme Court to dismiss the case, arguing that the Osun Attorney General lacked legal standing and that the court had no jurisdiction to hear it directly.

He added that the disputed council chairmen’s tenure runs until October 22, 2025, and statutory allocations should be released to them.

Olujimi also accused the plaintiff of abusing court processes by filing multiple similar cases in different high courts.

The AGF’s counsel urged the court to dismiss the suit entirely for lacking merit.
