A Federal High Court in Ibadan, Oyo State, presided over by Justice Ayo Emmanuel, has struck out the suit filed by the Olubadan of Ibadan, Oba Saliu Akanmu and others against the State Government of Osun and Iwo Local Government.
According to a release by the State of Osun Ministry of Justice Information Officer, Opeyemi Bello, the Olubadan had approached the Court, claiming that the paramount ruler of Ibadanland has native control over the Ogboru town which is presently under the control of Iwo Local Government in the State.
He had also claimed that Lagelu Local Government Area in Oyo State has territorial jurisdiction over Ogburo and its environs that fall on the same side of Odo Oba river in the State of Osun.
However, Jide Obisakin (Esq) Director of Litigation and Advisory Services, Osun State Ministry of Justice, representing Osun State Government and others, argued that the the Federal High Court has no jurisdiction to entertain the suit as the matter is presently before the National Boundary Commission for adjudication.
Justice Ayo Emmanuel, in his ruling, therefore declined to entertain the suit filed by the Olubadan of Ibadan and thereby struck out the suit.
